Under Sarah Palin, assuming she gets a say in appointing a Supreme, if
the court were to overturn Roe v. Wade, all it means is states would get
to decide whether or not abortion is legal or not. The federal
government or Supreme Cout cannot ban abortion unless Congress passes a
new federal law.

So if the Supreme Court overturns Roe v. Wade, unless that state
government also banned abortion, then your little worst case scenario
wouldn't apply.

Then she'll be in charge of foreign policy. That's the big problem.
She can't do that much to **** up domestic policy because Congress has
such a large say over legislation. Foreign policy is another matter.

The Senate will be in the 55/44/Leiberman range after the election,
she'll never do anything but hit her gavel once in a while..IF she is

Exactly.

We *know* Obama will appoint anti-constitutional judges. With McCain,
we don't know how it will go.

It is one of the few areas where the election is important, as the two
candidates are generally very poor choices.

McCain seems to be more aware (read _honest_) regarding the structure
of governance in the US (federalism). I say this with respect to his
comments regarding a possible marriage amendment, if the federal
judges overreach.

Since Obama hates federalism, he hates america, since that is a
defining characteristic of america. We know what he will do. He
promised change. I believe him.

Scary stuff.

Poor choices, but one candidate seems to have the edge in "least bad."

Regardless of one's views on abortion, and what state law ought to be,
Roe v Wade was an anti-constitutional ruling. Obama will attempt to
destroy whatever might be left of the constitution. Know it.
Democrats are a bunch of nationalistic chest pounders who hate
america. I used to be one. I know.

The strange thing about abortion is that there is no national law
regarding it. There is a Supreme Court decision, but no Congressional
Law. As iot stands now, a woman's "right" to abortion stems from a
Supreme Court decision unsupported by law.

The proper place for abortion law is at the state level, but things are
so confused and acrimonious that we may never get this solved. There
are too many single-issue people on both sides of the issue.

Your characterization of Palin is correct.

McCain - no.

The religious conservatives don't like him because, other than the
issue of abortion, he isn't with their agenda. In the past he's shown
open disdain for the social conservatives. It's something he isn't
doing now because he wants to be president. He "tapped" someone like
Palin for VP in an attempt to win them over.

I'll guess that if McCain gets elected, Palin will be totally
marginalized like most (not all) vice presidents. The problem is what
happens if McCain kicks the bucket.

The states can make sure abortion is allowed, or not allowed, and the
feds can't say jack **** about it. That is the rule-of-law. I get
the feeling you don't like the rule-of-law. I get the feeling that is
a fact, but I can't head my head into it. I guess all this makes you
a republican, by your definition.

That is not correct.

The Constitution does not address the issue of abortion in any way
whatsoever. How can something be unconstitutional if the Constitution
doesn't address it?

RvW states that a woman has the constitutional right to an abortion
under the right to privacy provision in the Constitution. As such, it
is a national law. No state or municipal law can ban abortion
because it would violate RvW. The Congress is also powerless to make
abortion illegal for the same reason. Congress could. however,
propose a constitutional ammendment making abortion illegal. If such
an amendemnt was ratified, it would void RvW. Finally, the SCOTUS
could itself overturn RvW.

Seriously, we need a revolution. If I didn't have to get up out of my

The decision is based on the constitutional right to privacy.

There are many constitutional rights that are not mentioned in the
Constitution. One of our most precious rights is habeas corpus, but
it is also not mentioned in the Constitution. The right to habeas
corpus is based on the right of due process.

There is a huge body of case law that goes along with the
Constitution. Most of this case law comes from the SCOTUS in its role
of interpreting the Constitution.

RvW is the law unless it is either overturned by the SCOTUS, or a
constitutional amendment is passed banning abortion. In reality, the
chance of a constitutional amendment is remote. So it's up to the SC.

unless when in cases of rebellion or invasion the public safety may
require it.

The presence of this clause in the constitution was one of the clubs
the Anti-Federalists used to bludgeon the Federalists with in the Anti-
Federalist's demand for a Bill of Rights.

Ironically, the weapon was ultimately turned back onto the Anti-
Federalists.
